Section 1 - Our Products
a) Descriptions and photography
The products we sell are either photographed or digitally produced and are accurately displayed on the website, however, due to different types, styles and settings of computer monitors shading and colour may appear differently to the exact colour. Due to this we advise that you visit us in store before placing your order to ensure that you are happy with the colour and quality before ordering. Whilst every attempt will be made by Blarney St. Fires & Stoves to ensure that the goods sold and delivered match in every respect to any display model or description shown or sent to you, any minor or immaterial variation, change in colour or pattern between the sample or description and the goods delivered shall not entitle you to reject the goods nor to claim any compensation for such variation or change.
Section 2 - Measurements
Many of the goods we sell are made according to standard industry sizes and as such, confirm to standard chimney measurements. Blarney St. Fires & Stoves accept no responsibility for any irregular measures present with a customer’s chimney, chimney opening, chimney wall or flooring that may conflict with the measurements of our goods. If you are unsure about any products or how to measure please call our customer services team on 021 4395587 for help before ordering. You must check the product details and measurements of the goods before placing your order and are responsible for checking the order. We at Blarney St. Fires & Stoves view customer satisfaction as our number one priority. Therefore, if the goods you have received are faulty, please contact us within 24 hours of receiving the goods. Were applicable we may ask you to return it to us in its original condition within 7 days of receiving the goods and we will issue a refund for the item. This means that they must be returned in their unmarked original packaging and must be fully re-saleable.
In any case where we have dispatched an incorrect item, Blarney St. Fires & Stoves will, where applicable, dispatch a replacement item. In this instance you will be billed for the Item and a refund will be issued for the incorrect item once it is returned to us as described above.
If you have ordered an incorrect item, Blarney St. Fires & Stoves will, where applicable, dispatch a replacement item. In this instance you will be billed for the new Item and a refund will be issued for the incorrect item once it is returned to us as described above. In this case, Blarney St. Fires & Stoves will charge a restocking fee of 20% of the price of the good which includes the collection by courier of the incorrect item.
Please note that we will not accept any returns after 14 days.
Before returning anything to us you must get a returns authorisation number from us, call us on 021-4395587 for a returns number, please note that anything returned without this number will not be refunded.
Section 3 - Made to measure products
Made to measure products are custom made to your precise requirements. Once made, our products are suitable only to you and therefore cannot be cancelled or returned. It is extremely important that you are sure about the product that you want and the size you require. We advise that you take advantage of our large showrooms and view the product before placing an order, Blarney St. Fires & Stoves cannot be held responsible if you dislike the colour or the general quality of the product. We strongly recommend that you double check your order to ensure that the products ordered, and measurements taken are correct. Full payment must be received prior to order. This does not affect your statutory rights.
Section 4 - Made to measure products - Measured by Blarney St. Fires & Stoves
Made to measure products are custom made to your precise requirements and may have been measured by Blarney St. Fires & Stoves. Once made our products are suitable only to you and therefore cannot be cancelled or returned. It is extremely important that you are sure about the product that you want and the size you require. Blarney St. Fires & Stoves cannot be held responsible if you dislike the colour or the general quality of the product. We strongly recommend that you double check your order to ensure that the products ordered, and measurements taken are correct. Full payment must be received prior to order. This does not affect your statutory rights.
Section 5 - Tolerance
Please note that material is cut by highly skilled professionals who will be as accurate as possible within a variance of +/- 3cm. We will not replace the order if the sizes are within this tolerance limit and you will not be entitled to reject the goods.
Section 6 - Stoves
Our stoves come with a limited manufacturer warranty. The timeframe of the limited warranty varies from manufacturer to manufacturer and applies to the main structural body of the stove only. It does not include wearable components of the stove such as but not limited to ; door handles, door hinges, internal stove components, stove glass, stove rope, enamel paint, stove frames, stove pipework and chimney cowls. It is the responsibility of the customer to maintain the stove and chimney correctly and to burn high quality fuel only (high quality coal and dry wood [<17% moisture]) Blarney St. Fires & Stoves accept no responsibility for customer negligence.
Our stoves are installed with respect to the aspect and alignment of the chimney and wall that it is installed to. We cannot accept responsibility for any misalignments, poor condition, poor aspect or poor circulation of the chimney and/or the wall. The stove will be installed to suit the existing structure as-is. No complaints or disputes will be accepted in this respect as there is no guarantee of 100% suitability.
With respect to installing existing stoves, not purchased from us, we do not accept any liability of damage caused as a result and do not stand over the quality of any existing stove. The customer assumes all risk in this instance. Any works carried out post-installation to the stove, wall, flooring, chimney or room in general is entirely the customer’s risk. The removal of an existing stove may lead to the need for additional work to be carried out post-installation eg: plastering, painting/decorating, flooring etc. Blarney St. Fires & Stoves do not provide these services and do not accept any liability for damages caused.
Section 7 – Fireplaces
Our fireplaces (entirety and surround only) are installed with respect to the aspect and alignment of the wall that it is installed to. We cannot accept responsibility for any misalignments, poor condition or poor aspect of the wall. The fireplace will be installed to suit the existing structure as-is. No complaints or disputes will be accepted in this respect as there is no guarantee of 100% suitability. This will be entirely the customer’s risk. Any works carried out post-installation to the fireplace, wall, flooring, chimney or room in general is entirely the customer’s risk. The removal of existing fireplaces may lead to the need for additional work to be carried out post-installation eg: plastering, painting/decorating, flooring etc. Blarney St. Fires & Stoves do not provide these services. We will not accept any liability to damage caused to the fireplace or surrounding structure as a result. The customer assumes all risk.
Section 8 - Order processing and our contract:
a) Order cancellation or amendments
When ordering your goods, you are agreeing to a legal binding contract. According to Consumer Contracts Regulations 2013, made to measure goods, e.g. custom made products are excluded from this legislation and the 7 day cancellation rights do not apply. Cancellations are still possible and a full refund will be issued as long as products or parts of them have not been made. In the event that your goods have already been made we are unable to refund your money. Telephone us as soon as possible if you wish to cancel or change an order and we can check if the order has gone into production. We strongly advise that you check your order and are happy with it before accepting to proceed with it.
Section 9 - Ordering by telephone
Our customer services team will always repeat orders back to you; please be advised that we do not accept claims based on incorrect sizes or products being inputted by us; therefore in the case of orders placed over the telephone we cannot accept such claims.
Section 10 - Prices
The price you will pay is the total price shown. These prices are inclusive of VAT and the total price shown is the price you will pay. On receipt of your sales receipt, check to ensure you are completely happy with the price of the goods ordered.
Section 11 - Payment
A - When ordering products from Blarney St. Fires & Stoves, we can only process your order when the goods ordered have been paid for in full. You can pay by phone with all major credit cards or debit cards. Your payment card details will never be stored to minimise the possibility of unauthorised access or disclosure. Authority for payment must be given at the time of order. You will be charged for items at the point of order. Our liability to you in connection with any order will not exceed the total price charged for the relevant items.
B - When ordering products with a home consultation/ survey, a deposit of a minimum of 50% of the total order must be made before the order is processed. The remaining balance will be payable upon booking of the installation. For payment, we can accept cash or card.
C - Goods remain the property of Blarney St. Fires & Stoves until full payment is received.
Section 12 - Acceptance
A- We have the right to cancel your order if:
1) We have insufficient stock to make and deliver the goods ordered.
2) If you have ordered from an island or country where we do not deliver.
3) The goods ordered unbeknown to us have been discontinued.
4) A pricing error or typing error has occurred due to system failure within our database or website.
5) If the customer alters or cancels the delivery/ installation date and a rescheduling date is not possible.
If for any reason beyond our reasonable control, we are unable to supply a particular item, we will notify you as soon as possible. No discounts or compensation can be offered under these unforeseen circumstances.
B- By placing your order with Blarney St. Fires & Stoves, you have confirmed that you have read our terms and conditions. In the event of the order being placed after a consultation, a signature may be obtained by you, the consumer. The terms and conditions have been sent to you with the full quotation and by placing the order, you are agreeing to them.
Section 13 - Delivery of your goods
We specify an estimated dispatch time on each product, please note that if we specify 7 days it means 7 working days from the moment payment reached our bank account. The specified delivery terms do not apply during busy times of the year, e.g. bank holidays and the Christmas period. Delivery will be made to the address specified by you. All deliveries will be made to you by our representative. We do our best to secure delivery within the period quoted but shall not be liable for loss occasioned by delay in delivery or arising out of any cause beyond our control. We advise you not to book a fitter (excluding installation provided by us) to install a product until the order has been delivered and that you have checked that there are no defects and that all parts are complete.
Section 14 - Installation of goods by us
At Blarney St. Fires & Stoves, all of our installers are fully trained professionals. For the installation of our goods, we will remove any existing fireplace/ stove that are installed. We cannot take away your old fireplace/ stove or any rubble associated with its removal. We will then install all of your new goods ordered. We take away ALL of our packaging and cardboard. We strive for excellence when installing each and every one of our products. As we are drilling into walls, we are completely unaware of any obstacles, cables, pipework ect that may be hidden behind the plasterwork. With this in mind, we will not under any circumstances accept liability for damage to anything that is not visible to us before works commence. In respect to flooring (including skirting boards and beading) and tiles, we are unaware at how strong or weak the flooring/ tiles that we may have to drill into are and are unaware of how much adhesive that your tilers used while applying your tiles. We will take all necessary precautions to reduce the risk of damage or cracking to flooring/ tiles however we will not be responsible for damage in the process of us installing your fireplace/ stove. There is an inherent risk that soot and/ or dust may dislodge during the installation process. We will not be held responsible for any damage to paintwork as a result of the installation process. In order to ensure a safe working environment for our fitters it is a condition of these terms that the area in which the works are to be carried out is cleared of, pets, plants, furniture, breakable items and household residents. We will not accept any complaints or costs for breakable items that are not removed prior to installation by the householder.
Section 15 - Defective and damaged goods
All Blarney St. Fires & Stoves products are rigorously quality checked before dispatch but in the unlikely event that you experience any problems please e-mail us at blarneystfireplaces@gmail.com or call our customer service team on 021 4395587. You have 7 days following receipt of your goods to report any damaged or defective goods due to manufacturing, or damage caused while being in the delivery process. We will deal with your queries promptly and if necessary arrange for a replacement to be sent. We reserve the right to ask for digital pictures with regards to the issues reported or to ask for the product to be returned to us for inspection. This does not affect your statutory rights.
Section 16 - Warranty
Blarney St. Fires & Stoves offer a limited manufacturer’s warranty (Stoves only, see section 6) on manufacturing faults. There is no warranty on our fireplaces (includes insets, hearths, firebacks, grates and front bars). We reserve the right to either replace or repair the product and it may be necessary to return the goods to us for inspection prior to a replacement product being despatched. This does not affect your statutory rights.
Section 17 - General
These Product Terms shall be governed by and construed in accordance with the laws of Ireland and any disputes will be decided only by the Irish courts. If any of these Product Terms is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Product Terms which will continue to be valid and enforceable to the fullest extent permitted by law.
We are committed to protecting your privacy. We will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 1998).
We collect information about you for 2 reasons: firstly, to process your order and second, to provide you with the best possible service. We will not e-mail you in the future unless you have given us your consent. We will never pass your details on to any third party without your express permission. We will give you the chance to refuse any marketing email from us in the future.
The type of information we will collect about you includes:
- Your name
- address
- phone number
- email address
- credit/debit card details
We will never collect sensitive information about you without your explicit consent. The information we hold will be accurate and up to date. You can check the information that we hold about you by emailing us. If you find any inaccuracies we will delete or correct it promptly.
The personal information which we hold will be held securely in accordance with our internal security policy and the law. If we intend to transfer your information outside the EEA (European Economic Area) we will always obtain your consent first.
We may use technology to track the patterns of behaviour of visitors to our website. This can include using a "cookie" which would be stored on your browser. You can usually modify your browser to prevent this happening. The information collected in this way can be used to identify you unless you modify your browser settings.
